HIRING TERMS OF SERVICE

1. Introduction & Scope

These Hiring Terms of Service ("Hiring Terms") govern your use of the RECNCY Hire platform ("Hiring Service"), accessible at hire.recncy.com and related subdomains. The Hiring Service is operated by Recncy ("we", "us", "our").

These Hiring Terms are supplementary to and should be read in conjunction with the General Terms of Service and Privacy Policy. In the event of a conflict, these Hiring Terms take precedence with respect to the Hiring Service.

2. Definitions

  • "Employer" - any individual or entity that creates a company account on the Hiring Service to post job adverts, search the talent pool, or otherwise recruit pilots.
  • "Pilot" - a user of the RECNCY platform who has created a pilot profile and may or may not have opted in to the talent pool.
  • "Job Advert" - a position listing created by an Employer through the Hiring Service.
  • "Talent Pool" - the searchable database of pilots who have opted to make their profiles discoverable to employers.
  • "Company Account" - the organisational account created by an Employer, including all team members invited under that account.

3. Employer Account Registration

  • You must provide accurate, current, and complete company information when creating a Company Account.
  • You represent that you have the authority to act on behalf of the organisation you register.
  • You are responsible for all activity that occurs under your Company Account, including the actions of invited team members.
  • You must maintain the security and confidentiality of all account credentials.
  • You must promptly notify us of any unauthorised access to your Company Account.

4. Plans, Payments & Billing

4.1 Pricing Models

The Hiring Service offers the following pricing models, each subject to the fees displayed at the time of purchase:

  • Campaign - a one-off payment to publish a single job advert for a fixed duration (currently 30 days).
  • Monthly Standard Subscription - a recurring monthly payment providing 3 active job adverts, talent pool access with filters, pipeline management + messaging, and 3 team seats.
  • Monthly Premium Subscription - a recurring monthly payment providing unlimited job adverts, full talent pool access + all filters, comparison tools, analytics, unlimited team seats, and priority support.

Campaign listings run for the campaign duration shown at checkout. Subscription listings may use a different default expiry in product settings.

4.2 Billing & Payment Processing

All payments are processed securely through Stripe. All prices are displayed in Australian Dollars (AUD) unless otherwise stated. By subscribing or purchasing a campaign, you authorise us to charge your nominated payment method. Subscription fees are billed in advance on each monthly billing cycle.

4.3 Cancellation

You may cancel your subscription at any time from your Company Account settings. Upon cancellation, you will retain access to subscription features until the end of your current billing period. Campaign payments are non-refundable once the job advert has been published.

4.4 Refunds

Refunds for subscriptions are provided at our sole discretion. If a campaign job advert has not yet been published, you may request a refund within 7 days of purchase by contacting us at recncy@recncy.com.

4.5 Price Changes

We reserve the right to change our pricing at any time. For active subscriptions, price changes will take effect at the start of your next billing cycle. We will provide at least 14 days' notice of any price increase via email.

5. Job Adverts

5.1 Content Requirements

All job adverts must:

  • Accurately represent the position, requirements, responsibilities, and compensation (where stated).
  • Comply with all applicable employment, anti-discrimination, and equal opportunity laws and regulations.
  • Not contain false, misleading, or deceptive information.
  • Relate to a genuine, current aviation employment opportunity.

5.2 Prohibited Listings

You may not use the Hiring Service to post adverts that:

  • Require pilots to pay fees as a condition of employment (pay-to-fly schemes).
  • Discriminate on the basis of race, gender, age, religion, disability, sexual orientation, or any other protected characteristic, except where a genuine occupational requirement exists under applicable law.
  • Are for positions that do not genuinely exist or are used solely to collect personal data.
  • Promote or facilitate any illegal activity.

5.3 Moderation

We reserve the right to review, edit, or remove any job advert that we determine, in our sole discretion, violates these Hiring Terms, is misleading, or is otherwise inappropriate. No refund will be issued for adverts removed due to a violation of these terms.

6. Talent Pool & Pilot Data

6.1 Consent & Opt-In

Pilot profiles in the talent pool are made available only when a pilot has explicitly opted in to be discoverable by employers. Employers may search and view these profiles as permitted by their plan.

6.2 Permitted Use of Pilot Data

You may use pilot data obtained through the Hiring Service solely for:

  • Evaluating pilots for genuine employment opportunities at your organisation.
  • Communicating with pilots through the Hiring Service's built-in messaging system regarding specific positions.

6.3 Prohibited Use of Pilot Data

You may not:

  • Download, scrape, copy, or export pilot data in bulk for use outside the Hiring Service.
  • Sell, share, license, or otherwise distribute pilot data to any third party.
  • Use pilot data for marketing, advertising, or any purpose unrelated to recruitment.
  • Store pilot personal data in external systems beyond what is reasonably necessary to progress a specific hiring decision, and in compliance with applicable privacy laws.
  • Contact pilots outside the Hiring Service using information obtained solely through the talent pool, unless the pilot has independently provided you with their contact details.

6.4 Data Accuracy

Pilot profiles are self-reported. While we encourage accuracy, we do not independently verify the information provided by pilots. Employers are responsible for conducting their own due diligence, background checks, and licence verification as part of their hiring process.

7. Messaging & Communication

  • All communication with pilots through the Hiring Service must be professional, relevant, and related to genuine employment opportunities.
  • You may not use the messaging system to send spam, unsolicited marketing, or messages unrelated to recruitment.
  • You may not harass, intimidate, or send abusive messages to any pilot.
  • We reserve the right to monitor messages for compliance and may suspend messaging privileges for violations.

8. Team Members & Permissions

Company Accounts may invite additional team members with role-based permissions. The account owner is responsible for:

  • Ensuring all invited team members comply with these Hiring Terms.
  • Managing team member permissions and access levels appropriately.
  • Promptly revoking access for team members who leave the organisation or no longer require access.

We are not liable for any actions taken by team members on your Company Account.

9. No Guarantee of Hiring Outcomes

RECNCY is a recruitment platform and does not guarantee any specific hiring outcomes, including but not limited to the number or quality of applications received, the suitability of any pilot for a role, or the successful filling of any position. The Hiring Service facilitates the connection between employers and pilots but does not participate in, endorse, or guarantee any employment relationship.

10. Employer Representations

By using the Hiring Service, you represent and warrant that:

  • You are a bona fide aviation operator, employer, or authorised recruitment representative.
  • All job adverts represent genuine, lawful employment opportunities.
  • You will comply with all applicable employment, privacy, and anti-discrimination laws in your jurisdiction.
  • You have the necessary authorisations, licences, and approvals to operate and employ staff as described in your listings.
  • You will handle all pilot personal data in accordance with applicable data protection and privacy legislation.

11. Acceptable Use

In addition to the acceptable use provisions in the General Terms, you agree not to:

  • Use automated tools, bots, or scripts to interact with the Hiring Service or extract data.
  • Create multiple Company Accounts for the same organisation to circumvent plan limits.
  • Misrepresent your organisation, its size, operations, or any aspect of the positions you advertise.
  • Use the Hiring Service to collect pilot data for purposes other than genuine recruitment.
  • Interfere with or attempt to manipulate match scores, analytics, or any other platform metrics.

12. Intellectual Property

All aspects of the Hiring Service - including its design, interface, software, matching algorithms, analytics tools, and documentation - are the intellectual property of Recncy. You are granted a limited, non-exclusive, non-transferable licence to use the Hiring Service in accordance with these Hiring Terms. You may not copy, reverse-engineer, or create derivative works from any part of the Hiring Service.

13. Disclaimer of Warranties

The Hiring Service is provided on an "as is" and "as available" basis. We make no representations or warranties regarding the accuracy, completeness, or reliability of pilot data, the availability of qualified candidates, or the uninterrupted operation of the Hiring Service. We expressly disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability and fitness for a particular purpose.

14. Limitation of Liability

To the maximum extent permitted by law, Recncy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Hiring Service, including but not limited to: loss of revenue or anticipated savings; costs of recruiting through alternative channels; damages arising from hiring decisions made using the platform; or any loss of data. Our total aggregate liability for all claims relating to the Hiring Service shall not exceed the amount you paid to Recncy for the Hiring Service in the six (6) months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless Recncy and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: your use of the Hiring Service; any job adverts you publish; your treatment of or interaction with pilots; your violation of these Hiring Terms; or your violation of any applicable law or the rights of any third party.

16. Suspension & Termination

We reserve the right to suspend or terminate your Company Account at any time, with or without notice, if we determine that you have violated these Hiring Terms or engaged in conduct harmful to pilots, other employers, or the platform. Upon termination:

  • Your right to access the Hiring Service ceases immediately.
  • Active job adverts will be removed from the platform.
  • You must cease all use of pilot data obtained through the Hiring Service.
  • No refunds will be issued for the current billing period or published campaigns.

17. Privacy & Data Protection

Your use of the Hiring Service is governed by our Privacy Policy. As an employer, you are also a data controller with respect to any pilot personal data you process outside the platform as part of your recruitment activities. You are responsible for ensuring your use of such data complies with all applicable data protection laws, including providing appropriate notices and obtaining necessary consents.

18. Governing Law

These Hiring Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Australia and the State of New South Wales. Any disputes arising from these Hiring Terms or the Hiring Service shall be resolved through good-faith negotiation, and if necessary, the exclusive jurisdiction of the courts of New South Wales, Australia.

19. Changes to These Terms

We may modify these Hiring Terms at any time. When we do, we will revise the "Last updated" date above. Material changes will be communicated via email to the primary contact on your Company Account or via a prominent notice within the Hiring Service. Your continued use of the Hiring Service after changes take effect constitutes acceptance of the revised Hiring Terms.
